You can sue in small claims, but some states allow the defendant to move the case to superior court. This means you will go up against an attorney. That could get expensive, which means the move is usually a ploy to intimidate you. Remember, if you lose you pay court costs & atty fees. Even if you win, you have to collect. Chances are you will throw good money after bad.

Some legal services give free advice. I would suggest checking with them before you do anything. That is after you've had a few beers, a few deep breaths & a hot bath;-)

PS- In business school they taught us about an accounting/finance principle called "sunk cost". That means once you've spent $$ on something it's gone. There is no justification in throwing more $$ into something simply because you already have big $$ in it. Otherwise you end up with a gold-plated,diamond-encrusted turd. Better to just cut your losses & move on.
