got my first ticket in my Maverick this morning

    yeah well I just found out that the wife and I know (not really well but have been aquainted with on several occasions) the Lieutenant at Sergant a$$holes barracks. Now I am in a quandry whether to call her or go ahead and take it to the judge... I am not sure between the lieutenant or the judge who will come down harder on Officer $hithead and Sergant jacka$$

    I mean I am sorry I know a police officer's job can be hard and stressful and I am respectful to the majority of Officers that I come in contact with but these two just make my blood boil... The officer needs to know the dang goen laws if he going to write ticket for things and the Sergant needs to be a man and admit one of his Officers made a mistake and take responsibility and bit the bullet and fix the problem.....

    So like I said if I seem like I was ragging on Police in general I totally appologize to any LEO on this forum, I hold you and what you do in the highest respect as long as you don't let the power go to your head and think you can just write people citations for anything anytime you feel like it even if you are in the wrong....

    The cop gave you a way out. With the wrong offense listed the court has to throw the ticket out. If he tries to change the offense in court then you can say that he can't know better now what happened than he did at the time and ask for a dismissal.
    You really do need to calm down though. A judge once sent me to "anger management" classes because I was ticked off at the officer. I had to pay court costs and for the clss but I didn't get the ticket on my record... Go figure.

    I disagree...
    My Son got a ticket for...laying 200' of drag...in my 6cyl. S10. :yup:
    In Ga. being under 21 he was going to loose his D/L. for 1 yr.
    I went to court with him to tell the Judge "that didn't happen in a S10, stock 6 cyl., no way-no how".
    Well the Judge agreed with me and ...reduced the charge down...I was happy, but when he went to pay the... fine and court cost...we found out the lesser charge was going to get his D/L also. :yup:
    The clerk sent it back to the Judge, the Bailiff put it on the ...bottom of the stack of cases...(another 2 hr. wait).
    Came his turn again...The Boy, Judge, Policeperson and myself were up to the Bench again. The clerk had whispered in the Judges ear the situation when she brought the papers out to him earlier.
    The Judge asked the ...Policeperson..did she hear something? She told him yes, so he reduced it down to a ...City noise ordinance...no points and it didn't go to the State, so he wouldn't loose his D/l...$125 +court cost...:yup:
    ...the first charge was changed to a 2nd., that was changed to a 3rd., the fine and court costs were the same...not what we wanted to hear, but...
    ..."We chose to be Happy"... :yup:

    I myself got pilled over for "excessive acceleration", did it right in front of the policeman:rolleyes: did see him here, but his presence became quickly known. Anyhow, we go through all the usual stuff... do you know why I pulled you over?.... and so on. At the end of it he said that I may or may not get a ticket in the mail, depends on what he decides to do with it, (something about it being a public ordinance thing not a motor vehicle violatioin?) waited and waited, and nothing:thumbs2:

    Not really relevant to the story, but I did have the lap belt part of the 5 point harness on. Also my factory shoulder harnesses disappeared when I put in the headliner.

    yeah in Most parts of MD it isn't called excessive accel, it is call exhibition driving. (or hotdogging it) hahahaha

    yeah he gave me a way out but not intentionally and he should have never written the ticket to begin with. It is going to cost me at least 8 - 1/2 hours of leave if I decide to take it to the judge.
    I may still opt to call the lieutenant instead of burning up my annual leave at work but who knows I may just take it to court for the principle..... But as far as calming down.. I will be totally calm with either the judge or the Lieut. I am just venting here, I know when to watch my P's a Q's and when I can act a fool hehehehe

    ok..this is what you do... first off.. you found the law.. and that proves it, this is my guess.. he proably knows that you are right, and he wrote the ticket anyways.. just to waste your time.. why else would he have put the wrong date (first reason the judge will throw it out) and he put the wrong place for the ticket (second reason the judge will throw it out)

    in any instance of a ticket... if the arresting officer fills out the ticket incorrectly, it is thrown out.. so you have nothing to worry about,.

    make a copy of the law... print out from the internet.. and anything else you need to prove it... go back to the exact spot that the cop got behind you , and take a picture of the exact spot that the ticket was issued, and then when you get to cross examine the officer, you will show him the picture, and say is this where you pulled me over, and he will say yes, and then you ask him where the location is on the ticket that he indicated, and when the officer has two different places, it will show the judge that the officer is clueless about where he is at..

    from what you have said, you have nothing to worry about..

    take a deep breath... calm down and dont worry about it

    NEVER argue with the man writing the ticket - he can, at the very least, make your life darn inconvenient. Call the judge and see what he says - you might not get the judge but it is worth a try. If you already have a court date you may be able to ask for a change of venue to a court that is closer. You have a better chance of connecting with the judge if you already have a date - see if you can talk to him - let him know that you learned your lesson about arguing with the officer.

    Arguing with a ticketing or arresting officer is just a good way to get you tazed and generally does nothing to change his/her mind.

    The court system works in such a way that an officer can arrest or ticket an innocent person and then you get your day in court where they have to prove your guilt.

    If an officer needed to have everyone dead to rights when he pulled you over or made an arrest, no one would ever get arrested.

    The system isn't great, but 60% of the time, it works every time.

    honestly I was not arguing with him at first. I was VERY polite AND yes sir, No sir, until he came back with the ticket in hand AFTER he went back to his car and had plenty of time to look up the law on the laptop computer in his car or could have called it in and aske the dispatcher would have know that law..

    to whoever said the officer and the judge are on the same side doesn't know Maryland (particularly P.G. county) very well when it comes to pittly petty BS. Tickets... P.G. county boarder Washington DC on the bad side of DC and all the murdering and drug dealing spills over into PG count Maryland and I have seen people within the past 5 years get let go by a cop or get off in court on a DWI charge with a donation to a charity because the courts in PG are so overbooked with more serious crimes..
    If I take this to court and tell the judge that I tried to explain it to the officer and then called the Sgt. and the Sgt declined to do anything about it the Judge is going to lay the officer wide open in front of everyone in that court room....

    I am actually more ticked off that it could cost me 8-1/2 hours leave then I am mad about anything else... I mean I think it is stupid that they had state police writing tickets for laws they don't even know but that is just life, it happens.. I guess I just hate it when someone doing a job is supposed to know what they are doing and they don't but make believe they do anyway and it is at the expense of other people.

    I am leaning more and more toward calling the Lieutenant and giving her the chance to take care of it because she is (or at least has been in the past) a very nice lady and I would hate for it to reflect poorly on her since the Sgt works under her.
