Need Advice Asap

    Have a couple from 70-72
    I came home from work last night and a big ass tree fell on my maverick, it totaled the whole left rear-end. I called my landlord told him about it he called the insurance company, supposevly, and they said the would cover the removal of the tree but not my car. Sounds like B.S. to me what do you guys think, or any advice on who to handle this? The car has no insurance it was not on the road, i just finished restoring the engine a few days ago. will post pics soon as i get a new camerea in a few days. Thanks

    that's one of those 'iffy' situations because you can try to sue him for the cost of damages but then again, they may tell u that u should have had renter's insurance. IMO, i'd seek legal advice from a lawyer that way you know what ur up against. hope this helps... :huh:

    What Dave said. Do you have renter's insurance? If so, check with them. This is one of the reasons to have some type of insurance? Good luck.:(

    Sounds like an "act of God" thing. A judge will likely say you should have had insurance on your property to cover this.

    You may have a slim chance - if you can prove the tree was a danger, like if it was rotten and a hazard and an accident waiting to happen. Take lots of pictures of the tree if it looks rotten. You might get a settlement if you sue and can prove the hazard.

    That's what I was going to say. You'll have to prove the tree was a hazard. A (known) hazard.

    Sorry to hear that. That makes what, two cars in two days damaged by trees/limbs... My '72 made it through a tornado this past Tuesday, thankfully with no damage. My brother drove it to work in Gainesville, GA, and literally part of the building where he works was destroyed by the tornado, with the Maverick sitting in the parking lot..

    If you had notified the landlord, in writing, that you felt the tree was a hazzard then you can sue for negligence. If you never brought it up then it is "an act of God" and the insurance company has no legal reason to cover your car. If you have or had comprehensive coverage on the car then your insurance MAY cover the damages. It depends on what your policy covers.
    Other than that you will have to fix it yourself.

    and i think...if you prove it was a hazzard, then you will have to explain why you parked the car under it...:yup:

    You can't blame the landlord for the wind/weather blowing the tree over. If you had comprehensive insurance on the car, it might have been covered. When you don't insure your property, you will suffer loss.

    Another thing that I found out from my insurance company is that homeowners specifically does not cover cars. For instance the question that I asked my insurance company was...what would happen if my garage collapsed on my car? The agent said that they would fix the garage, not the car. He said that you have to have car insurance (my drag car never had insurance). Sorry for the bad news...wish I could help more. We all feel your pain.

    Update

    My insurance company on my other vehicles said i cannot make a claim until i have my landlords insurance info. and he will not give that to me. I guess at this point i am going to have to make a personal claim with a lawyer. really was not a act of nature my car was no where under the tree, a few years back he had issues with the tree and the insurance company just came and trimmed the branches that were hanging over the house which in time made the tree start to lean, this is a big tree. not sure if you seen it at the house dave it was the tree right next to the house. PS jimmy sorry to hear about your car, this **** just sucks.

    yup, i remember the tree.... big @$$ oak from the best of my memory. and i would have to say that i agree with you, it sounds like something that would have to be filed with your attorney

    Paul is exactly correct....no negligence on the part of your landlord. His carrier will not pay for sure. And actually, even if you HAD notified him about the potentilal hazard, they probably would not have paid anyway because you knew about the hazard and chose to park there anyway. If you had comp covergae it would have been covered. Tough break...your on your own on this one. How bad is the car? Any broken glass, ect? Did it hit the roof or just the rear end. Sorry to hear of your bad luck, but a good excuse for that new paint job !!
