got my first ticket in my Maverick this morning

    and boy am I pissed off too..

    Got it for not wearing my seatbelt..... I tried to explain to the officer very politely at first that the Maryland law is written that I do NOT have to wear it in any car that is tagged Class L (historic) which both of my mavericks are tagged that way. and the reason being is because the shoulder strap has no retractor and it is dangerous because when tightened up the way it should be you can't lean forward to look right or left at an intersection and if it is loose enough that you can it leave too much slack and can cause serious damage to your chest if you are in an accident

    He told be in a very bold tone that "You either wear the seatbelt or you DON'T drive the vehicle on the road ad ALL!!!"

    he went back to his care which I figured maybe he would radio it in and double check but noooo he came back with the ticket anyway.... that's when I got ****ty. snatched it out of his hand signed it and handed it back and told him to give me my copy of the freaking (I used the other "f" word) ticket.

    Put my seat belt on and waited for him to pull out and get about 50 yard up the road and left the shoulder spinning gravel...

    I looked up the law:

    Exempt from the mandatory seat belt use law are:
    • Those who have a written certificate from their doctor stating a medical reason for not using their seat belt.
    • Drivers and passengers of Class L (historical) motor vehicles.
    * Children younger than 16 years of age in every seating position in all vehicles

    But wait it gets better

    The citation he wrote the ticket for was (operator or occupant under 16) not restrained by (seat Belt or child safety seat) TO top that off......

    He wrote the date on the ticket for yesterdays date 04/17/2008 and gave me the ticket this morning...
    and wrote the Maryland coutny code as county code #16 which is Montgomery county Maryland and I was right at the Charles/Prince George's county line when he pulled me over... Montgomery county is probably 25 -35 miles away from where I was...

    Needless to say I am going to the barracks either in a few minutes when I am done eating lunch or on my way home and have a talk with officer dumbass's supervisor.....

    Been there, done that. There's another law that deals with vehicles made before the mandatory seatbelt act in I think '74, if you need more ammo.

    here's another great freaking update from the wonderful Maryland State (a$$holes) I appologize to any police officers ont he board but Now I am steaming out of my ear HOT as a firecracker.....

    I just called the police barracks and talked to the supervisor and told him that the ticket was written under the wrong violation code, wrong date on the ticket, can't read the officers name, wrong county code and I have a copy of the exemption printed out from the MVA website that states that vehicles tagged historic are EXEMPT from the seatbelt law......

    Guess what Mr. supervisor told me??? don't pay it and take it to court.

    I told him that I already was made 30 minutes late for work this morning, and now he's telling me that I have to take a day off from work to co to court at a courthouse the is 30 miles from my home. I asked him why I couldn't bring the ticket into the barracks and have him void the ticket and he said he cannot do that after it is written... OOOOOHhhh!!! boy did he get an earfull... I know for a fact that is Bull$hit because they did it for my mother not long ago when a cop pulled her over and got smarta$$ with her and wrote her a ticket for something bogus and the seargant on duty tore the ticket up and made sure it was taken care of....


    Oh I am going to court and I sincerely hope that SAB cop gets a thorough reaming by the judge for wasn't the court's time...

    I told the SGT that I would be sure to let the judge know that he felt it was worth wasting the courts time and Money to have me come to court for a $25 BOGUS seatbelt ticket in a county that is competing with Washington DC for drug crimes and murders

    Anyone got a valium or something so I can calm down......

    If you have a copy of that I would certainly appreciate it... the more ammo I have against these Son's of Bioootches the better I will feel.....

    Yeah I always speak nice to the Judges.... When I was a lot younger and stupid I got myself in trouble for DWI and went to court with my big time high power Attorney that happened to be a state senator and the States attorney wanted to give me a year in Jail straight time with no work release. My attorney stood there fumbling and studdering over his words and I asked the Judge if I could speak for myself he agreed to let me and the first thing I said was I told the lawyer to sit down and shutup then by the time I got done talking, the Judge looked at me and said Mr. Stultz I am glad you spoke up because I was prepared to go with the State's attorneys request and give you a Year in Jail but after hearing what you had to say for yourself, I think you learned your lesson and I am reducing it to 120 days with 30 day off for good behavior and I am granting your 6 days a week work release as long as you have a job on the day you turn yourself in... This was in October and he gave me until after the holidays were over before I had to go in, so I didn't have to turn myself in until the begining of February.....

    But that's neither here nor there, just a half interesting story......

    The thing I am debating right now id I have the lieutenant's name for that Barracks and I am debating whether to cal her or whether to take this to court and let a judge know that this SGT. and his Trooper think it is worth the courts time and money to have me come to court over a $25 bogus ticket.....

    I also have the option of calling the courthouse and talkign to the States Attorney and seeing if he/she will throw it out before it goes to court.... They are the ones that generally arrange community service and such so they may throw it out before it get to court

    It varies here in Maryland I think it can go up to $75 depending on if you were also speeding, or driving agressively and so on.

    The thing about all of this that really burns my arse is the fact that I got a ticket maybe 8 or 9 months ago while driving my 96 Dodge truck for not wearing my seatbelt. I was polite to the officer and I paid the ticket happily and went on my merry way... It is my choice not to wear the seat belt and the law says I have to in certain vehicles and if I get caught not wearing it then that is on me.... but one of the reasons I like driving my Maverick so much is the law says I don't have to wear the seatbelt... I am a grown adult and I don't think it is right that the gov't can tell you that you HAVE to do something that may or may not be good for you AND there is a good possibility that it may do more harm than good... The cases go both ways.... a lot of people have their lives saved by wearingthe seat belts and a lot of people are seriously injured and or killed because they were wearing a seatbelt.

    Case in point a friend of mine in high school got in an arguement with his GF left her house mad and driving waaaaayyy to fast, left the road estimated at over 100 mph. the car went 200 yards down in the woods and was so twisted up that you honestly could not tell what it was.
    he was ejected from the car and landed in a pile of soft dirt, he was injured but the police told him that had he been belted into the car they prolly wouldn't have even found much of his body.....

    anyway I digress I am steppign off my soapbox for the afternoon. I'll let you all know if I call the lieutenant or if I wait and let the judge or even maybe call the states attorney....     My shoulder belts mysteriously disappeared shortly after I got the Comet home leaving only bolts where they were. Both of the times I was pulled I was wearing the lap belt and the police officers both saw my car has no shoulder belt. No ticket.

    I figure if they aren't permanently attached to the lap portion then they must be optional.

    funny-- my shoulder belts disapeared too. they must have disentegrated from all the years in the sun. in their place was nice shiny chrome nuts.

    The seat belt in my '74 Grabber did a lot of good when I got in a wreck. It just snapped.. :rolleyes:
