You dont want to hire a lawyer even though you can sue for attorney fees. You can also sue for filing fees & process service fees. But you may want to pay an hour of a good lawyer's time & they will tell you exactly what you can & cant do. They are usually very helpful in helping you get things filed properly. (voice of experienced here) Then add his fee in with the lawsuit. Even if he has no money, you will get a judgement against him & it goes on his credit report until it's paid off. If he comes into any settlements like workmans comp, you can collect your money. As I said before, Document everything. The more prepaired you are the better your chances.
